Bankruptcy Mortgage Project

The Bankruptcy Mortgage Project is an initiative created by the National Consumer Law Center, Inc. It serves as a comprehensive online resource for a diverse community, including courts, consumers, trustees, mortgage servicers, attorneys, and academics involved in bankruptcy proceedings. The project's primary aim is to organize and provide access to a wealth of legal documents such as local rules, forms, general orders, and court opinions pertinent to various mortgage issues within consumer bankruptcy cases, particularly Chapter 13.

This project focuses on assisting consumers who utilize Chapter 13 bankruptcy to prevent home foreclosure. While not a direct lender or broker of loans, it offers crucial information on navigating complex processes like curing mortgage defaults through cure plans, addressing issues with inaccurate servicer claims, and understanding legal concepts such as lien stripping. Its content is designed to empower individuals and legal professionals with the knowledge required to successfully manage mortgage obligations during bankruptcy.

Funded in part by a grant from the Endowment for Education of the National Conference of Bankruptcy Judges, the Bankruptcy Mortgage Project acts as a vital informational hub. It is dedicated to clarifying the procedural requirements for treating junior mortgages, facilitating loan modifications, and resolving fee disputes, ultimately supporting consumers in their efforts to emerge from bankruptcy with current mortgages.
